Are My Devry Navient Student Loans Uncollectible? – Anne

Dear Steve,

I have a Navient student loan and I was reading the article about how I might be able to get them discharged depending on the school.

I went to Devry and Keller. And I don’t know if its rumors but I always hear they are not qualified schools plus I haven’t been able to use my degrees and I have applied for positions with my masters. Its basically worthless.

Plus I wondered if you can get federal student loans gone too. Because the school had had some but then the depart of education had got them or something.

I forgot to ask what the statue of limitations is. How long do they have before it runs out they have to sue or you don’t have to pay and does it apply to all of they chase Navient federal or just some?

It looks like both schools are Title IV qualified at the moment but that doesn’t mean they were when you went to school there. That would take some research on your part.

The issue about the statute of limitations is a bit confusing. The length of time is dependent on a number of factors, including what state you live in and if you’ve been out of the state for any length of time. When you need a definitive answer about the statute of limitations it is always been to consult with an attorney who is licensed in your state.

The statute of limitations does not prevent you from being sued but it is a defense you can raise if you are sued. And the statute of limitations has nothing to do with attempting to collect from you. Just because a debt is out of statute and you can’t be sued over it anymore does not mean they can’t attempt to collect and get you to slip up and start the statute of limitation clock over.
