Consumer Complaint: After pulling my credit reports on XX/XX/XXXX I discovered a collection account listed on all three bureaus ( XXXX, XXXX and XXXX ) by XXXX XXXX of XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX, XXXX, IN XXXX. I immediately sent a certified letter to XXXX XXXX giving them official notice of dispute. I also requested validation, made pursuant to the Fair Debt Collection Practices Act and the Fair Credit Reporting Act, along with the corresponding local state laws. I asked them to note that I was requesting ” validation ” ; that was competent evidence bearing my signature, showing that I have ( or ever had ) some contractual obligation to pay them. This letter was received and signed for on XX/XX/XXXX. After waiting 30 days with no response from XXXX XXXX I pulled all three credit reports again only to discover that they had not removed the ” Collections ” listings from my reports nor had they marked them as ” Disputed ” as required by The Fair Debt Collection Practices Act and the Fair Credit Reporting Act, along with the corresponding local state laws.
On XX/XX/XXXX I mailed XXXX XXXX a second certified letter which was delivered and signed for on XX/XX/XXXX. Now it has been almost another 60 days from the receipt of this second letter with no response or action taken by XXXX XXXX as required by the FDCPA and FCRA. Their failure to adhere to FDCPA and FCRA requirements and local laws is seriously damaging my credit.
I have maintained a careful record of my communications with XXXX XXXX, letterdelivery signatures as well as time stamped credit reports that clearly document non compliance by XXXX XXXX to FDCPA/ FCRA requirements and to local laws. I will provide a copy if needed.
