“Dear Steve,
I have cancer and lost my job with CC debt and loans and I am married with a home in joint ownership but underwater. Is it possible for just me to declare bankruptcy?
Thanks,
Bill”
Dear Bill,

There really isn’t enough information for me to give you anything specific but it is always possible for just one person in a relationship to file bankruptcy.
But to figure out if that is a beneficial approach for you in your situation we’d need to know the type of debt you have, if you have any assets or equity, what state you live in, etc. There are a lot of variables to consider.
Any joint debt you have will fall on the shoulders of the other joint account holder if you filed bankruptcy. I would suggest that you click here to find a local bankruptcy attorney and have a free consultation with them to discuss the specifics of your particular situation.
If you do that then we can make a better decision based on facts and realities.
By the way, best of luck with the cancer battle. Certainly the financial stress does not make that situation any better. By addressing the debt situation it gives you a better chance for a brighter future.

Thanks Steve. I have CC debt of $36K, PLUS loans of $70K and a car loan for $12K in my name. Mortgage is joint an 2 months behind, but Citimortgage wants us to use our only savings to pay them. Started working with a HUD counselor to help.
I was self employed and now out of work. Applying for SSDI.
God bless you for what you do.
Bill
