I saw you giving advice and I need some guidance. About a year ago I lost my job as did my wife. I had purchased a Spa years back but fell behide in payments. When I told the Spa company it was impossible for me to pay since I had no work and my wife did not. He then said he would have the balance waived. We never received it in writing though.
Now I have a job but make less then on unemployment 15OO my wife is making 600 on unemployment and we are being sued. As you can see its not much money to pay rent and basics. Never the less I want to see if there is a way to settle making payments or whatever I don`t want to go to jail! Even if I have to cut Electricity or water please help me

Dear Adam,
First off, you are not going to jail over this.
Depending on what state you live in, your wages could be garnished if you are sued and lose. But before we get too far ahead of ourselves here, is this your only debt? If not, what kind and how much other debt do you have?

Thank you for your quick response! Â I live in California & yes this is the only debt. The money we make is not really enough and to top it off food stamps just cut us off saying we make to much money? What should I do? I know the debt before was 5000 I tried to work with them as I previously mentioned but they wanted money upfront which was and is impossible. Not sure if they may be asking for more now that MCR Receivables is involved and filed a civil case. I don`t have to show till 2015 and have not been severed yet either

Well it’s an interesting situation since this is really your only debt.

If they sue you, you’d really need legal advice from an attorney licensed in your area or may check to see if you are eligible for legal aid.
However, if the debt is valid, you admit you owe the money, and they have to authority to sue you over this valid past due debt, then it is what it is. But let’s not get too far ahead of ourselves and instead let’s take this step by step.
