I Might Get a Cash Settlement in the Future. Can I File Bankruptcy Now? – Jami

“Dear Steve,

My husband and I are currently in a fair amount of debt, living paycheck to paycheck. Sometimes having to use our credit cards to buy groceries or pay for gas 2 days after payday. I am looking for ways to get out of it, possibly by filing bankruptcy, but I am going to be receiving a small settlement check for the death of my father in April.

If I file bankruptcy, will that money have to be accounted for or will it be taken from me? The amount of the check is going to be more than the debt owed unless I include my house and my husband’s student loan. Any help or advice you can give me in this matter would be greatly appreciated.

The best advice would be to meet with a local bankruptcy attorney as soon as possible and work out a game plan.
