My School Took Out a Navient Student Loan in My Name I Didn’t Want

Question:

Dear Steve,

I had taken out a student loan to go hair styling school…I went from December 2013 to February 2014…I found that I did not like it and pursued something else. I paid $1,000 down to the school also took a student loan if needed….well in February when I found I did not want to do this the school did not take the student loan at that time…they said come in sign some papers and we will not take the money…every time I called the school to sign these papers they were never available…guess what they took the loan anyway…..now I have a student loan for $3,000…I have called Navient and they say I am still responsible….I even had called Navient beforehand and told them that I was not in school and did not need the loan…..they took it anyway…. I don’t feel I owe anything….I was in school only for 2 months…..and Navient has added a lot of interest….

Answer:

Dear Mariah,

Wow. I think you’ve got a great case and you need to speak to a consumer attorney about this situation. You might want to talk to one of these consumer attorneys in your state who specialize in student loans, click here.

If the loan was obtained fraudulently and Navient is attempting to collect, there may be additional issues surrounding the Fair Debt Collection Practices Act.

Since this could be a complicated contract issue and involves a number of legal issues i would strongly suggest getting the help of an attorney who is licensed in your state.

Don’t fool around, let’s get this dealt with properly now so it does not harm your credit further and linger into the future.

Sincerly,

You are not alone. I'm here to help. There is no need to suffer in silence. We can get through this. Tomorrow can be better than today. Don't give up.
