I got an American Express judgment against me in TN general sessions court in June 2008. Even though I was a victim of identity fraud (which I explained in court) the judge ruled against me and a judgment was rendered against me for over $25,000.
The AM Express attorney filed the judgment in June 2008 and then filed a complete satisfaction in July 2008 . I have a page and book number for the full satisfaction. Dec 2009 I was served with a subpoena duces tecum by this same attorney for this same judgment to several bring items on Jan 25,2010.
I called this attorney office and was told that the satisfaction was filed by mistake. This same attorney then sent a “correction of satisfaction” to the clerks office saying the “full satisfaction” was filed in error. (A year and a half later!) Do I have to supply my company escrow account bank statements which is other folks money?
They have asked for all of my Real Estate company as well as personal bank accounts. Is this legal? When the subpoena was served they had not filed the “correction”. Was I improperly served since it then showed filed at the courthouse as satisfied? Any help would be greatly appreciated! I own absolutely nothing and have not worked in several years. This personal account was in my name only. We are surviving on my husband`s income only and he is having to sell blood twice a wek to make ends meet. (I would be selling mine to but I am diabetic and they won`t buy mine) Thanks,in advance!
Do I have to supply escrow bank statements even though money there is not mine?(My husband still sells a very few houses and this escrow account is used for that) There is very little money at any time in this account because sales are rare.
American Express does not fool around. The best thing you can get now is legal advice for a lawyer licensed in your state. Do not depend on casual advice from the web for an issue like this. Find a local attorney and discuss this situation with them, please.
