Consumer Statement:

Restless; and not being able to focus in my work and scare of money situation, paying bills.

Consumer Action Taken:

10 years ago discover card got a default judgment against me, as I failed to reply there summon.
Then on January 28 2013, a collection firm send me a summon with a complain behalf of Discover Card referring the 10 years old judgment and gave a 20 days to reply to that summon, I mailed them a letter in response to with Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.

However, they reply back to me but did not comply with the validation and also did not provide me a copy of the original signed loan agreement or credit card application. I also reply back to them with a letter stating that they have failed to send adequate documentation and proof, and have not complied with the violation of the FDCPA, section 809 (b).

This collection company did not have the original judgment against me. That was Discover card through another collection firm.

The old judgment expired on March 10, 2013 but they went to the court on March 28, 2013 and got a default judgment against me on April 2nd 2013 .

•They did not notify me for court hearing.
•They failed to provide me validation within 30 days.
•This collection company did not have the original judgment against me. That was Discover card through another collection firm.
•They did not provide me verification or copy original judgment.
•And they renewed the judgment in court after the old judgment is expired by saying that I did not response to the summon.

I need your help how to vacate this default judgment, and lawyers are asking me so much money to do that. Please help me

I have the copy of summon, and letters. I mailed them those letters with notarized and with return receipt

  • You have to appeal the judgment now. You could have filed a motion to dismiss for violation of the statute of limitations and won. Your failure to defend yourself got you the negative judgment. The SOL in MN is 6 years for consumer debt which means no one can collect from you 6 years after the last payment. The last payment is generally reported on your credit report but keep in mind it is placed there by the original creditor and that information is subjective. Credit reports are a bunch of crap. Messerli and Kramer should be disbarred. PERIOD. They are rotten low class bottom feeders who are getting a free ride from lack of consumer protection.

  • Yes, my letter is certified with return
    receipt, and attorney (collection debt firm) replied to my first letter of
    requested validation but they have failed to send you adequate proof of your legal
    obligation to pay a debt it did not have the information I
    requested, then I followed by another letter (certified with return receipt)
    that they failed to provide me the proof and
    documentations for the below items from 1 to 9 these items are also included in The First letter I mailed to you of requested validation under the Fair Debt Collection
    Practices Act, 15 USC 1692g Sec. 809 (b).

  • Discover has the option to hire another attorney and renew the judgment, that is what may have happened here. they do not need to notify they renewed the judgment. I would sure your letter is certified.
