Consumer Complaint: I received the attached email message this evening asserting that I have a past due amount ( see XXXX ). However, I have no amount that is currently due and have either paid the minimum amount due or in excess of such amount each month. Attached are my statements from the last three months, each prepared by the servicer after monthly payments were due, and a record prepared by the servicer of my payments for each month. The servicer failed to apply a payment I made on XXXX XXXX, XXXX ( see attached Discover Payment History and Discover XXXX XXXX, which states that I have a past due amount ). In addition, the servicer is demanding payment based on my XXXX statement ( attached ), despite that I made a payment on XXXX XXXX, XXXX without having a statement available at such time ( see Discover Payment History ; note : the XXXX statement was not created and uploaded into my account until XXXX XXXX, XXXX, after I complained to a supervisor named XXXX ). The servicer ‘s demand for payment on XXXX XXXX and this evening constitute a deceptive practice ( see 12 USC 5536 ( a ) ( 1 ) ( B ) ; see also Section 5 of the FTC Act for the definition of ” deceptive ” ).
